Published in ABA's Landslide, May 2013. In Gunn v. Minton, the Supreme Court was faced with the issue of whether state tort-law based professional malpractice claims stemming from federal patent infringement litigations should be brought in state or federal courts. This article examines the prior Federal Circuit precedent, the case-within-a-case structure of legal malpractice cases, and the relationship between patent practitioners and the rules and argues for guiding precedent and consistency through uniformity.
Published 42 Tex.Tech.L.Rev. 913 (2010). The article analyzes the origins and elements of promissory estoppel: its use in case law contrasted with the purported 'restatement' in §90 of the Second Restatement of Contracts, and the related-and-often-confused §139 of the Second Restatement of Contracts. Emphasis of the article is application of promissory estoppel theories in the context of oral contracts and the Statute of Frauds.
